Are contingency fees legal in Hong Kong?
Not in court litigation. Contingency and conditional fees remain prohibited for litigation in Hong Kong because of the common-law rules against maintenance and champerty. Since 2022, outcome-related fee structures, including conditional and damages-based agreements, are allowed for arbitration under the Arbitration Ordinance, subject to a code of practice.
