Conditional fees, yes. Under the Lawyers and Conveyancers Act 2006, a lawyer may agree to be paid only if the case succeeds, and may add a premium to normal fees, as long as the agreement is in writing and the fee is fair and reasonable. Fees calculated as a percentage of the amount recovered are restricted.
