Are contingency fees legal in Portugal?
No, not as a share of the result. The Portuguese Bar Statute prohibits quota litis, an agreement where the fee depends exclusively on the outcome and consists of part of what is obtained (article 106). Lawyers may, however, take the result into account when setting a fee, alongside the work done and other criteria.
