Are contingency fees legal in South Africa?
Yes, under the Contingency Fees Act 66 of 1997. A lawyer may agree to charge no fee if the case is lost and a success fee if it is won. The success fee may not exceed the normal fee by more than 100% and, in money claims, may not exceed 25% of the total amount awarded.
