Who pays if I lose a case in the Netherlands?
The loser usually pays a fixed-rate contribution to the winner's costs (liquidatietarief), set by a court scale and normally much lower than the real cost of the case. Each side therefore pays most of its own lawyer's fees, win or lose, unless a funder, a claims agency or an insurer covers them.
