Who pays if I lose a case in Switzerland?
The losing party normally bears the court costs and pays the winner a contribution to its lawyer fees set by cantonal tariffs (article 106 of the Civil Procedure Code), which may be lower than the real fees. Courts can also ask the claimant for an advance on costs before the case goes ahead.
