Are contingency fees legal in Spain?

Yes. Spanish lawyers may agree a fee that depends on the result (cuota litis) since the Supreme Court upheld in 2008 a competition ruling against the Bar's ban. Fees are agreed freely with the client, often as a percentage of what is recovered plus a smaller fixed amount, and should be put in writing.
