Who pays if I lose a case in Brazil?
The loser pays honorários de sucumbência to the winner's lawyer, normally 10% to 20% of the award or the amount in dispute (article 85 of the Code of Civil Procedure), plus court costs. With free legal aid (gratuidade de justiça), payment is suspended and can only be demanded if your situation improves within five years.
